Contractors with 50+ employees awarded public works contracts exceeding $50,000 must develop and file affirmative action plans with the Commission on Human Rights and Opportunities.

The executive director must review and formally approve, conditionally approve, or disapprove affirmative action plans within 120 days of submission; plans deemed approved or deficient without consequence after this period.

Approved plans receive a certificate of compliance valid for two years, serving as prima facie proof of contractor eligibility to bid on future contracts.

For contracts subject to part II of chapter 60, the executive director must review plans within 60 days and approve, approve with conditions, or reject; the state or municipality withholds 2% of monthly contract payments until approval is obtained.

All changes are effective October 1, 2018.
