Consent orders entered by the Commissioner of Energy and Environmental Protection may not be modified or revoked unless a material breach occurs or the party fails to disclose material information.

Remediation requirements and standards in consent orders concerning land parcels cannot be modified unless both the commissioner and the party agree to the modification.

The commissioner or any party to a consent order may seek declaratory and injunctive relief from Superior Court to resolve disputes concerning the terms, conditions, and compliance of the consent order.

Declaratory and injunctive relief under this act is available in addition to any other administrative or civil remedies allowed by law.

These provisions apply to all consent orders entered on or after the effective date of the act.
