Prohibits food establishment owners or operators from providing or distributing single-use expanded polystyrene (Styrofoam) containers to consumers, effective January 1, 2021

Establishes escalating fines for violations: $250 for first violation, $500 for second violation, and $1,000 for third and subsequent violations

Exempts pre-filled and sealed containers sold by food establishments and Styrofoam containers used by butchers or stores for raw meat sales

Authorizes local health departments and state agencies (Public Health, Consumer Protection, Energy and Environmental Protection) to enforce the ban, with municipalities receiving half of local fines

Requires joint report by February 1, 2022 from three state commissioners assessing enforcement and evaluating the need for hardship waivers for financially impacted food establishments
