HB 5823 Summary

• Candidates for state senator, state representative, Governor, Lieutenant Governor, Attorney General, State Comptroller, Secretary of the State, or State Treasurer must file an affidavit certifying whether they intend to abide by Citizens' Election Program expenditure limits.

• Participating candidates must certify that committee treasurers will spend Citizens' Election Fund moneys according to regulations and that candidates will repay any improperly spent funds.

• Participating candidates may withdraw from the program before applying for an initial grant without penalty, but cannot withdraw after receiving a grant.

• When a campaign treasurer spends 15 percent or more of Citizens' Election Fund moneys on campaign services from a consultant or professional person, that consultant must register with the State Elections Enforcement Commission and certify their intent to abide by program expenditure limits.

• The State Elections Enforcement Commission must prepare and make publicly available lists of participating candidates, nonparticipating candidates, and registered consultants or professional persons.
