Substitute Bill No. 6392 Summary

• Commissioner of Transportation may install and operate automated traffic enforcement safety devices in highway work zones to detect vehicles exceeding posted speed limits by 10+ mph, or contract with a vendor for this service.

• Devices must record only vehicle license plates and not occupants or surrounding persons; signs must be posted at work zone entrances and devices only operate when highway workers are present.

• State Police officers must review recorded images and authorize summons issuance within 10 days if reasonable grounds exist; summons mailed to registered vehicle owner with image copies.

• Recorded images are destroyed after 90 days if no summons issued, or upon final case disposition if summons issued; images cannot be used as evidence in other proceedings.

• All standard legal defenses available to defendants include: emergency vehicle passage necessity, injury avoidance, stolen vehicle status, prior separate conviction for same incident, non-owner operation, and compliance with other motor vehicle regulations.
