The Adjutant General is responsible for approving all leases and uses of military facilities and must require applicants to provide certificates of insurance indemnifying the state and federal governments against bodily injury or property damage.

Military facilities may be leased or used by military organizations, nonprofit organizations, organizations receiving state aid, governmental agencies, and members of the armed forces of the state.

Leases cannot conflict with drill nights of active military organizations, federal military regulations, or military facility purposes, and subleasing is prohibited.

The Adjutant General may allow reduced-rate leases at actual operating cost to schools, the American Red Cross, governmental agencies, agricultural associations, charitable military organizations, and armed forces members holding significant military career event ceremonies.

Youth military organizations may use military facilities at no cost, and proceeds from facility leases must be transmitted to the State Treasurer for deposit in a military facilities account (effective July 1, 2019).
