Allows municipal agencies to participate in competitively procured programs organized by nonprofit energy buying consortia without complying with municipal competitive bidding requirements, effective October 1, 2019.

Defines "competitively procured program" as one where the nonprofit consortium publishes procurement notice at least 15 days in advance in newspapers and on their website in at least 10-point type, with clear evaluation criteria and best value standards.

Permits procurements of electricity, natural gas, renewable energy, demand response, energy efficiency, solar, storage, and other energy-related products through the nonprofit consortia.

Prohibits municipal buyers located within a community served by a municipal electric utility from purchasing electricity, electricity-related products, or renewable energy through the consortium.

Requires nonprofit energy buying consortia to be recognized as tax-exempt under Internal Revenue Code Sections 501(c)(3) or 501(c)(4) and to consider factors beyond price including supplier financial strength, change in use or law provisions, and customer service capability.
