Commissioner of Social Services shall provide Medicaid coverage for medically necessary pasteurized donor breast milk effective July 1, 2019, to the extent permitted under federal law.

Coverage requires a physician, physician's assistant, or advanced practice registered nurse to sign an order stating the milk is medically necessary for an infant Medicaid beneficiary.

Donor breast milk coverage is available when the infant is medically or physically unable to receive maternal breast milk or breastfeed, or when the infant's mother is medically or physically unable to produce sufficient maternal breast milk.

Commissioner shall adopt regulations establishing infant birth weight thresholds, health conditions qualifying for coverage, and time limits for Medicaid coverage of pasteurized donor breast milk.

Commissioner may implement temporary policies or procedures posted on the Department of Social Services website and eRegulations System while formal regulations are being adopted, and shall seek federal Medicaid waiver or state plan amendment approval if necessary.
