Commissioner of Social Services must ensure Medicaid beneficiaries receive nonemergency medical transportation coverage upon request.

Transportation providers cannot exceed 15-minute waiting times for scheduled pickups to appointments or 30-minute waiting times for return trips, unless a documented weather or traffic emergency prevents access.

Providers cannot offer a different mode of transportation than requested by the beneficiary if the requested mode is medically necessary.

Providers must maintain a transportation network capable of meeting all nonemergency transportation needs of state Medicaid beneficiaries.

Medicaid beneficiaries denied medically necessary nonemergency transportation may seek civil injunctive relief from Superior Court, which may order the Department of Social Services to impose penalties on contracted transportation vendors.
