Repeals and replaces Section 52-557n, effective October 1, 2019, establishing when political subdivisions and their employees are liable for damages to person or property.

Political subdivisions are liable for negligent acts or omissions of employees acting within scope of employment, negligence in functions generating special profit, and acts creating or participating in nuisances, except for defective road or bridge injuries.

Political subdivisions are not liable for criminal conduct, fraud, malice, willful misconduct, or negligent acts requiring exercise of judgment or discretion as an official function.

Provides ten specific exemptions from liability including natural land conditions, weather-related road damage without notice, unpaved recreational access roads, judicial proceedings without malice, third-party acts, discretionary permit decisions unless constituting reckless disregard, and inadequate inspections unless constituting reckless disregard.

Provides immunity for uncompensated municipal board, commission, committee, or agency members from personal liability for acts, errors, or omissions made in good faith and within official duties, unless caused by reckless, willful, or wanton misconduct.
