HB 7332 Summary

• Automatically transfers cases of children charged with capital felony, class A felony, class B felony, or violations of section 53a-54d from juvenile docket to regular criminal docket of Superior Court, effective October 1, 2019.

• Automatically transfers cases of children previously adjudicated delinquent or convicted of two or more felony offenses and charged with larceny to the regular criminal docket, provided the offense was committed after age 15 and counsel has been appointed.

• Allows prosecutors to file motions to transfer cases of children charged with class B felonies, certain larcenies, or specified assault violations back to the juvenile docket at any time after arraignment.

• Requires juvenile court hearings upon prosecutorial motion to determine if cases involving violent crimes, sexual offenses, and other serious felonies should transfer to criminal docket, considering the child's age (must be 15+), prior offenses, severity, intellectual disability or mental illness, and available juvenile services.

• Permits criminal court to return transferred cases to juvenile docket at any time before jury verdict or guilty plea entry for good cause shown.
