Repeals and replaces Section 16-233 of the general statutes, effective October 1, 2019, to clarify the use of municipal gains on public utility poles and underground communications ducts.

Grants towns, cities, boroughs, fire districts, and the Department of Transportation the right to occupy and use one gain per public utility pole or underground communications duct system without payment for any purpose, including consolidating administrative, business office, and information technology functions with other municipalities and entities.

Authorizes the Public Utilities Regulatory Authority to prescribe the location or relocation of such gains on public utility infrastructure.

Reserves all gains for exclusive use by the town, city, borough, fire district, or Department of Transportation that holds the right to them.
