Bill Summary: HB 7387

• Automatically transfers cases of children age 15+ charged with capital felony, class A felony, or class B felony to adult criminal docket, with appointed counsel prohibited from opposing the transfer.

• Allows prosecutors to file motions to return class B felony cases to juvenile docket at any time after arraignment in adult court.

• Requires court hearing for discretionary transfer of cases involving certain serious offenses (section 53a-55, 53a-59b, 53a-71, etc.) if child is age 15+, with court considering prior offenses, seriousness, intellectual disability/mental illness, available services, and completion of court-ordered programs.

• Allows prosecutors to request transfer hearings for class C, D, E felonies or unclassified felonies, with courts authorized to return such cases to juvenile docket prior to verdict or guilty plea for good cause.

• Requires courts to offer youth and parents the opportunity to participate in behavioral improvement classes or programs, which successful completion may factor positively (but failure cannot factor negatively) in transfer decisions.

• Effective October 1, 2019.
