SB 37 Summary

• Health carriers must issue immediate electronic authorization for temporary drug supplies when covered persons file grievances or request reviews of adverse determinations for non-controlled prescription drugs.

• Temporary drug supply authorizations must be sufficient to cover the entire duration of the grievance or review process, with confirmation of payment availability included.

• Health carriers must confirm with the prescribing provider within 24 hours of issuing authorization that the provider concurs with dispensing the temporary supply; authorization may be canceled if provider does not concur.

• Provisions do not apply to disputes involving substitution of generic or brand name drugs unless the prescriber specified no substitution for the specific brand name drug.

• All amendments take effect January 1, 2020 and apply to nonurgent care review requests, retrospective reviews, internal grievance processes, and external review processes under Connecticut insurance law.
