Expands legal fireworks sales and use to include all consumer fireworks permitted by federal law, with usage allowed from 6 p.m. to 11 p.m. any day and 11 p.m. on New Year's Eve until 1 a.m. on New Year's Day for persons age 21 and older.

Requires sellers to obtain a state license from the Commissioner of Consumer Protection and a federal fireworks license, with separate licenses needed for each retail location.

Mandates storage and sales only from permanent facilities complying with National Fire Protection Association Section 1124 standards and requires State Fire Marshal inspection and enforcement of age and time restrictions.

Imposes a 5 percent tax on initial fireworks sales at average wholesale price, with revenue deposited to a consumer fireworks account for distribution to firefighters cancer relief and state fire school training accounts.

Makes unlicensed fireworks sales an unfair trade practice and classifies violations of age/time restrictions or unlicensed selling as Class C misdemeanors.
