SB 697 Summary

• Prohibits employers from requiring employees or prospective employees to sign nondisclosure, nondisparagement, or similar clauses that prevent disclosure or discussion of sexual harassment or sexual assault in the workplace or at work-related events.

• Covers sexual harassment or assault occurring in the workplace, at employer-coordinated work-related events, between employees, or between employers and employees off-premises.

• Allows employees or prospective employees to sue in any court of competent jurisdiction for violations of this prohibition.

• Violating employers are liable for compensatory damages, attorney's fees and costs, punitive damages, and any legal and equitable relief the court deems appropriate.

• Effective July 1, 2019.
