Commissioner of Motor Vehicles shall establish and publish uniform rates and charges for nonconsensual towing and motor vehicle storage that are just and reasonable, with rates subject to reconsideration no more frequently than once every two years.

Commissioner may consider factors including Consumer Price Index, rates in other jurisdictions, and costs incurred by towing operators for equipment, insurance, and business expenses when setting or amending rates.

Wrecker operators may assess a $10 surcharge on each nonconsensual tow, but surcharge cannot be charged for vehicles towed during attacks, major disasters, emergencies, or state/municipal snow removal.

Wrecker operators must keep records for two years including vehicle registration numbers, tow dates/times, locations, mileage, charges, whether surcharge was assessed, and person requesting service, available for inspection by law enforcement.

Violations of recordkeeping requirements constitute an infraction; act takes effect October 1, 2019.
