Paul DeMaria, as administrator of Sarah DeMaria's estate and in his individual capacity, is authorized to present claims against the state to the Claims Commissioner despite failing to file proper notice within the required time limits.

The General Assembly finds that authorizing this claim serves a public purpose by ensuring full adjudication of cases involving alleged injuries caused by state actors and remedies an injustice for which the state bears responsibility.

Claims must be presented to the Claims Commissioner no later than one year after the effective date of this act.

The state is barred from using failure to comply with notice requirements, improper notice timing, or prior consideration of the claim as defenses against these claims.
