Commissioner of Social Services shall seek Centers for Medicare and Medicaid Services approval for a provider user fee uniformity waiver by July 1, 2017, to exempt nursing homes owned and operated by continuing care facilities registered with the Department of Social Services as of May 1, 2005.

Exemption applies regardless of Medicaid participation and includes nursing homes licensed after May 1, 2005 that are owned and operated by registered continuing care facilities.

Reduced user fees (less than the standard fee under section 17b-320) may be imposed on nursing homes owned by municipalities and nursing homes licensed for more than 230 beds to comply with federal requirements under 42 CFR 433.68(e)(2).

Commissioner shall seek an amendment to the waiver by September 1, 2019, to exempt the only operating, free-standing rest home with nursing supervision in the state from the user fee prescribed by section 17b-320.

Act takes effect upon passage and amends section 17b-323 of the general statutes.
