Repeals and replaces section 52-225a of Connecticut General Statutes, effective October 1, 2019, to modify collateral source payment rules in personal injury and wrongful death cases.

Courts must reduce economic damages awards by the total amount of collateral source payments received by the claimant, minus certain exceptions related to subrogation rights.

Exceptions to damage reduction include amounts subject to subrogation rights, amounts agreed upon in full satisfaction of subrogation, amounts where subrogation rights have not been waived or extinguished, and amounts equal to the claimant's comparative negligence reduction.

Courts must receive evidence regarding total collateral source payments, amounts subject to subrogation, and amounts the claimant paid to secure collateral source benefits before entering judgment.

Allows evidence that healthcare providers or insurers accepted payment less than billed amounts to be admissible in determining the total collateral source payments received by the claimant.
