SB 1010 Summary

• Sellers must notify prospective buyers at least 15 days before signing a purchase agreement of any dams or similar structures on the property, including hazard classification and inspection results.

• Buyers must register unregistered dams or structures with the Commissioner of Energy and Environmental Protection or record them on municipal land records within 30 days of purchase if required.

• Property disclosure form template must include a new question about dams or similar structures capable of impounding water, including their hazard classification, inspection status, emergency action plans, and any buyer obligations.

• Disclosure form must fit on pages no larger than 8.5" x 11", use minimum 9-point type, include property address and page numbers on each page, and contain buyer and seller initials on all pages except the signature page.

• Seller's representations on the disclosure form do not constitute a warranty to the buyer, and buyers are urged to conduct independent inspections by licensed professionals.
