SB 1041 Summary

• Repeals Section 4-215 to limit sole source personal service agreements to those between $20,000-$50,000 with terms not exceeding one year, requiring competitive bidding unless the secretary grants a waiver for qualifying services including cost-prohibitive competitive procedures, proprietary services, statutorily mandated contractors, or emergency services.

• Requires the secretary to immediately notify the Auditors of Public Accounts of any sole source audit service applications and give auditors an opportunity to review and advise whether services are necessary and could be provided by the auditors themselves.

• Prohibits state agencies from denying the Auditors of Public Accounts access to records and accounts, and authorizes auditors to examine information concerning audited entities held by private contractors, provided upon demand at no cost.

• Mandates that all state contracts entered into, renewed, or amended on or after October 1, 2019, include provisions allowing state contracting agencies to access contractor-held data concerning the agency upon demand in a prescribed format at no additional cost.

• Requires biennial audits of reimbursements from the Bradley Enterprise Fund to the Department of Emergency Services and Public Protection for Troop H operations under the department's memorandum of understanding with the Department of Transportation.

• All sections effective October 1, 2019.
