Establishes crime of unlawful dissemination of intimate image when a person intentionally shares photographs, films, videotapes, or recorded images of another person's genitals, pubic area, buttocks, or female breasts without full opaque covering, or of another person engaged in sexual intercourse, without consent and knowing the other person understood the image would not be shared.

Defines "disseminate" to include selling, giving, providing, lending, trading, mailing, delivering, transferring, publishing, distributing, circulating, presenting, exhibiting, advertising, or otherwise offering such images.

Excludes from prosecution images resulting from voluntary exposure or engagement in sexual intercourse in a public place or commercial setting, images where the person is not clearly identifiable, and images whose dissemination serves the public interest.

Criminalizes dissemination to one person as a Class A misdemeanor, and dissemination to more than one person via interactive computer service, information service, or telecommunications service as a Class D felony.

Prohibits imposing liability on providers of interactive computer services, information services, or telecommunications services for content provided by other persons.

Effective date: October 1, 2020.
