HB 5193 Summary

• Permits wreckers to assess a $10 surcharge on each nonconsensual towing or transporting of a motor vehicle, effective October 1, 2020.

• Prohibits the $10 surcharge on vehicles towed or transported during attacks, major disasters, emergencies, disaster emergencies, or state/municipal snow removal.

• Requires the Commissioner of Motor Vehicles to establish and publish uniform rates and charges for nonconsensual towing, transporting, and storage that are just and reasonable, considering factors including Consumer Price Index, costs incurred by tow operators, and equipment/insurance expenses.

• Mandates wrecker owners maintain detailed records for two years including vehicle registration numbers, tow dates and times, locations, charges, and whether the surcharge was assessed; violations constitute an infraction.

• Allows the Commissioner to reconsider and amend rates upon petition no more frequently than once every two years, with appeals of Commissioner actions heard in the New Britain judicial district.
