HB 5219 Summary

• Requires youth camp licensees to conduct comprehensive background checks including state and national criminal history records checks on prospective employees age 18 and older in positions requiring child care or involving unsupervised child access, effective October 1, 2020.

• Establishes youth camp licensing fees of $815 for general applicants, $315 for nonprofit organizations, and no fee for nonprofit-affiliated day camps operating five days or less with donated labor and materials.

• Mandates licensees check the state child abuse registry and prohibit employees from beginning work until federal requirements under 45 CFR 98.43(d)(4) are satisfied.

• Exempts youth camps operated by state agencies from background check requirements if the agency satisfies other applicable state and national criminal history records check requirements.

• Aligns youth camp background check requirements with child care facility standards, requiring checks at least once every five years and allowing exemptions for employees continuously employed within the past 180 days who completed checks in the previous five years.
