Employees may express breast milk or breastfeed on site at their workplace during meal or break periods at their discretion.

Employers must make reasonable efforts to provide a private room or location near the work area (other than a toilet stall) that is free from intrusion and shielded from the public.

The designated room or location shall include or be situated near a refrigerator or employee-provided portable cold storage device and have access to an electrical outlet, unless providing these constitutes undue hardship.

Employers are prohibited from discriminating against, disciplining, or taking adverse employment action against employees who exercise breastfeeding rights under this act.

The act takes effect October 1, 2020 and applies to employers with one or more employees, including the state and political subdivisions.
