Allows the Commissioner of Social Services to provide Medicaid payments for home care services retroactively up to three months before an individual applied for Medicaid, as permitted under 42 CFR 435.915.

Requires individuals otherwise eligible for home care services to apply for Medicaid benefits when requested by the Department of Social Services and to accept such benefits if determined eligible.

Bars retroactive medical assistance payments for any Medicaid applicant who transferred assets for less than fair market value within sixty months before applying for Medicaid.

Requires the commissioner to impose a penalty period in accordance with 42 USC 1396p(c)(1)(D)(ii) for applicants who made improper asset transfers.

Effective July 1, 2020.
