New and used car dealers and lessors must offer customers the optional service of etching the complete vehicle identification number on windshields and windows at the time of sale or lease, with the charge specified separately on the sales order.

Dealers selling motorcycles must offer to mark the complete vehicle identification number on motorcycle component parts, with marking standards including permanent etching using covert application, visibility after paint application, company identification information, and counterfeiting-resistant vinyl stencils.

Dealers and lessors must charge reasonable rates for marking services and file rate schedules with the Commissioner of Motor Vehicles, with rates capped at the most recently filed schedule.

Dealers, lessors, and companies performing component parts marking must maintain secure databases of marked vehicles and component parts that are accessible to the Department of Motor Vehicles and law enforcement agencies in the state.

The Commissioner of Motor Vehicles may adopt regulations establishing standards for component parts marking and marking of replacement parts by licensed repairers, effective October 1, 2020.
