Bill Summary: Raised Bill No. 246

• Makes the Department of Developmental Services' abuse and neglect registry available to the Department of Administrative Services for employment applicant screening across Children and Families, Developmental Services, Mental Health and Addiction Services, and Social Services departments.

• Allows the Commissioner of Developmental Services or regional/training school directors to authorize emergency medical treatment or surgical procedures for individuals under department custody without prior written consent when insufficient time exists to obtain required consent.

• Restricts legal representatives from accessing abuse and neglect reports when the legal representative is the alleged or substantiated perpetrator of abuse or neglect or resides with such perpetrator.

• Requires the Department of Developmental Services to conduct investigations into deaths of persons with intellectual disabilities when the department has direct or oversight responsibility for medical care and abuse or neglect is reasonably suspected.

• Encourages licensed residential facilities to adopt energy efficiency standards and environmentally friendly construction practices, with a reporting requirement to the legislature by July 1, 2021.
