Department of Energy and Environmental Protection shall authorize alternative treatment septic systems for failing septic system replacements if the system does not allow further property subdivision, does not increase bedroom count, and the Commissioner determines it is environmentally responsible and feasible to maintain.

Commissioner may authorize alternative treatment septic systems for commercial properties or multi-unit dwellings even if standard requirements are not met, if the system is the most environmentally responsible solution, will be properly maintained, and will not enable development that could not otherwise occur.

Act takes effect October 1, 2020 and creates new authority overriding provisions in the Public Health Code and titles 19a, 22a, and 25 of the general statutes.
