Expands Freedom of Information Act exemptions to include records maintained by public institutions of higher education (in addition to executive branch agencies) relating to faulty or failing concrete foundations in residential buildings

Broadens protected records to cover documentation related to "testing for" pyrrhotite concentration in concrete foundations, not just claims of faulty foundations

Removes the limitation that protected records must be "provided by owners" of residential buildings, extending protection to any records maintained or kept on file by covered agencies

Exemption applies to records prepared or obtained prior to May 25, 2016, and continues for seven years after receipt or seven years after May 25, 2016, whichever is later

Effective date: July 1, 2021
