The Commissioner of Transportation shall convey approximately 3.15 acres of state land in Wilton to the town at a cost equal to administrative expenses, subject to State Properties Review Board approval.

The town of Wilton must use the parcel exclusively for a landscaping business and must retain full ownership, except for sales or leases directly related to that purpose.

If the town fails to use the land for landscaping purposes, sells it to another party, or leases it for non-landscaping uses, the parcel automatically reverts to the state of Connecticut.

Any sale of the parcel must occur at fair market value determined by averaging appraisals from two independent appraisers selected by the Commissioner of Transportation, with sale proceeds transferred to the State Treasurer for the Special Transportation Fund.

The State Properties Review Board must complete its review within 30 days of receiving a proposed agreement from the Department of Transportation, and the State Treasurer shall execute the deed with provisions enforcing the landscaping business requirement.
