SB 100 Summary

• Adds "intersex characteristics" and related medical conditions to the definition of sex discrimination, protecting intersex persons from workplace and public accommodation discrimination effective October 1, 2021.

• Allows intersex individuals to identify their sex as "intersex" on state identity documents including motor vehicle operator's licenses and identity cards, with proof of intersex characteristics as prescribed by the Commissioner of Motor Vehicles.

• Permits the specification of a child's sex as "intersex" on birth certificates upon submission of evidence of intersex characteristics in a form prescribed by the Department of Public Health.

• Enables individuals to amend their birth certificates to change their sex designation to intersex through a notarized affidavit from a licensed physician, advanced practice registered nurse, or psychologist attesting to the applicant's intersex characteristics.

• Establishes a task force to study the medical necessity of surgery related to intersex status, with findings due to the Public Health Committee by January 1, 2022.
