Requires health carriers and Medicaid to cover brand-name prescription drugs without substitution when a prescribing practitioner specifies that no substitution is permitted and the drug is medically necessary despite availability of a therapeutically equivalent generic alternative.

Requires the prescribing practitioner to document in writing or by telephonic/electronic means both that the brand-name drug is medically necessary and the basis for that medical necessity determination.

Mandates the phrase "brand medically necessary" appear on the prescription with the practitioner's request.

Requires written certification in the prescribing practitioner's handwriting bearing the phrase "brand medically necessary" to be sent to the dispensing pharmacy within ten days of the prescription date if the request was made by telephone or electronic means.
