The Commissioner of Energy and Environmental Protection shall adopt regulations to implement the Transportation and Climate Initiative Program, which caps and reduces greenhouse gas emissions from transportation through declining emissions caps and allowance auctions.

Emissions allowance auction proceeds shall be deposited into a separate Transportation and Climate account within the Transportation Grants and Restricted Accounts Fund, with administrative costs not exceeding 5% of total annual projected allowance value.

Beginning in fiscal year 2022, at least 50% of auction proceeds must be invested in transportation projects and policies benefiting communities overburdened by air pollution or underserved by the transportation system.

An Equity and Environmental Justice Advisory Board shall be established with a majority of members from overburdened and underserved communities to advise on program decision-making and provide input on reducing air pollution and improving transportation.

The Department of Energy and Environmental Protection and Department of Transportation shall publish annual reports on program proceeds and investments starting October 1, 2024, with public opportunity for review and comment.
