Substitute Bill No. 939 Summary

• Licensed physicians who voluntarily provide emergency medical assistance to SWAT teams without compensation are immune from civil liability for ordinary negligence, effective October 1, 2021.

• Physician immunity does not apply to gross, willful, or wanton negligence.

• Licensed architects who voluntarily assist public safety officials in evaluating built environment safety after a major disaster are held to the same standard of care as public safety officials and subject to liability only for failing to act as a reasonably prudent public safety official would.

• Architect protections apply only during an active civil preparedness emergency declaration or for 60 days after issuance of such declaration, whichever period is longer.

• "Public safety official" includes state and municipal police, firefighters, building officials, community emergency response team members, emergency preparedness officials, and officials from the Department of Emergency Services and Public Protection or Federal Emergency Management Agency.
