Department of Public Health shall establish minimum staffing requirements of at least 4.1 hours of direct care per resident per day, effective January 1, 2022, comprised of 0.75 hours by registered nurse, 0.54 hours by licensed practical nurse, and 2.81 hours by certified nurse's assistant.

Commissioner of Public Health, in consultation with Commissioner of Social Services, shall review and redefine "direct care," review best practices for staffing levels, encourage payment incentives for staff retention, and prohibit hiring of persons subject to consent orders for health and safety violations.

Commissioner of Social Services, in consultation with Commissioner of Public Health, shall establish a minimum percentage of Medicaid reimbursement for direct care provision to nursing home residents.

Commissioner of Public Health shall adopt regulations to implement these staffing requirements in accordance with state law.

Act becomes effective October 1, 2021.
