Requires physicians, physician assistants, and advanced practice registered nurses to offer HIV tests at least once annually to patients age 13 and older in emergency departments or primary care settings, effective October 1, 2022.

Exempts providers from offering tests if the patient is in a life-threatening emergency, received a test in the prior year, lacks capacity to consent, or declines the test.

Mandates hospitals and primary care providers to develop protocols for offering and providing HIV tests, tracking test performance and declinations, reporting positive results to the Department of Public Health, and referring positive patients for treatment.

Requires the Department of Public Health to develop and post educational materials about HIV testing on its website by January 1, 2023, in consultation with community-based HIV organizations.
