Commissioner of Consumer Protection shall adopt regulations allowing licensed pharmacies to accept and dispose of home-generated sharps beginning January 1, 2024, starting with up to 50 retail locations in the first year and up to 50 additional locations each year thereafter.

Home-generated sharps are defined as hypodermic needles, pen needles, intravenous needles, lancets, and other skin-penetrating devices used by individuals at home to deliver medications.

Regulations must comply with federal law, establish tracking and monitoring systems with security requirements, specify pharmacy storage locations, and ensure secure removal and destruction in consultation with the Commissioner of Energy and Environmental Protection.

Commissioner of Consumer Protection shall develop a plan for a mail-back program allowing residents to safely dispose of home-generated sharps and report on the plan by January 1, 2023.

Section 1 takes effect October 1, 2022; mail-back program planning requirement takes effect upon passage.
