HB 5340 Summary

• Commissioner of Social Services shall set payment rates for family caregivers equal to rates for nonfamily professional caregivers providing the same services, effective July 1, 2022.

• Commissioner shall use professional caregiver rates to determine the value of personal care services provided by family caregivers under legally enforceable compensation agreements with Medicaid applicants.

• Medicaid retroactive coverage for home care services extended to up to three months before application date, to the extent permitted under 42 CFR 435.915.

• Individuals applying for Medicaid shall not be denied eligibility solely based on assets discovered after application if reported within ten days and liquidated within thirty days.

• On and after January 1, 2023, state-funded medical assistance extended to children eight years of age and younger regardless of immigration status with household income up to 201% of federal poverty level.
