HB 5446 Summary

• Requires individual and group health insurance policies to cover medically necessary infertility treatments including ovulation induction, intrauterine insemination, in-vitro fertilization, and related procedures, effective January 1, 2023.

• Expands the definition of "infertility" to include cases where a licensed physician determines treatment is medically necessary based on patient medical, sexual and reproductive history, age, physical findings, or diagnostic testing, not just failure to conceive within one year.

• Allows policies to impose limits including: coverage until age 40, maximum of four cycles for ovulation induction, three cycles for intrauterine insemination, and two cycles with maximum two embryo implantations per cycle for in-vitro fertilization.

• Permits religious employers and individuals with religious or moral objections to exclude infertility coverage, with required 10-point type notice in policy documents.

• Prohibits health insurance policies from discriminating based on expected length of life, disability, quality of life, age, race, color, religious creed, national origin, sex, sexual orientation, marital status, or gender identity.
