Substitute House Bill No. 5453 Summary

• Requires the state to post notices of all purchases and contracts exceeding $50,000 on the State Contracting Portal at least 5 calendar days before the bid submission deadline.

• Mandates posting of contract type, estimated value, nondiscrimination requirements, and affirmative action notices to maximize public participation and competition, including participation by small contractors and minority-owned businesses.

• Requires posting of any contracts not subject to competitive bidding or competitive negotiation on the Department of Administrative Services website, with exceptions for information protected under privacy law.

• Allows commissioners to waive competitive bidding requirements for emergency or minor nonrecurring purchases of $10,000 or less, and for alternative fuel vehicle purchases with appropriate approvals.

• Effective October 1, 2022, and applies to purchases and contracts for supplies, materials, equipment, and contractual services while exempting certain public utility services and janitorial contracts.
