The Commissioner of Administrative Services may purchase the Capitol Area System (district heating and cooling infrastructure serving state and non-state Capitol District facilities) from TEN Companies, Inc. under a November 4, 2008 Asset Purchase Agreement that is hereby ratified and approved.

The Commissioner may purchase an energy production plant located at 490 Capitol Avenue in Hartford from CDECCA Property Company, LLC under a Purchase and Sale Agreement dated 2022, including all related land, buildings, equipment, and fixtures that produce steam and heated/chilled water for the system.

The Commissioner may assume all vendor, customer, supplier, and third-party contracts related to the systems and may undertake obligations necessary to complete the acquisitions and operate the Capitol Area System.

A public works heating and cooling energy revolving account is established to deposit receipts from energy sales and pay for operation, maintenance, repair, and improvement of both systems, with costs allocated pro rata to state agencies and non-state building owners based on Secretary of the Office of Policy and Management-approved rates.

The acquisition is exempt from other state agency review, approval, or authorization requirements and from sales or conveyance taxes; the state retains the right to resell the Capitol Area System to a third party if determined to be in the state's best interest.
