Commissioner of Energy and Environmental Protection must consult with an independent arborist before authorizing removal or pruning of five or more trees per acre or any tree estimated to be 75+ years old, a species of special concern, or threatened or endangered species in state parks or campgrounds.

Department must post notice at least 10 days before tree removal or pruning (unless immediate public hazard exists), and any objecting person, firm, or corporation may petition for a public hearing with 10 days' notice.

Arborist must evaluate whether trees constitute immediate public hazards by considering proximity to public use areas, feasibility of pruning or pesticide alternatives, and the tree's age, history, social, and scenic value.

Commissioner must record the date, location, and arborist determination for any tree removed as an immediate public hazard and post this record on the Department's website within three days of removal.

Department must replant trees to replace any removed trees with comparable species that will achieve similar calipers, canopy, and aesthetic characteristics in the same state park or campground.
