Fair Right to Repair Act Summary

• Requires original equipment manufacturers to provide owners and independent repair providers with documentation, parts, and tools on fair and reasonable terms to diagnose, maintain, and repair digital electronic equipment.

• Defines "fair and reasonable terms" as pricing and conditions equivalent to what manufacturers offer authorized repair providers, including discounts and timely delivery, without additional burdens or conditions.

• Mandates manufacturers provide special documentation, tools, and parts necessary to disable and reset electronic security locks on digital equipment to owners and independent repair providers.

• Prohibits manufacturers from disclosing trade secrets unless necessary to comply with the repair provisions, and voids any contractual provisions attempting to avoid or waive these obligations.

• Excludes motor vehicle manufacturers, motor vehicle equipment manufacturers, and new motor vehicle dealers from the act's requirements; effective October 1, 2022.
