Employers must notify the administrative law judge and employee by certified mail before discontinuing or reducing prescription drug payments deemed reasonable or necessary by a physician.

Notice must specify the reason for discontinuance or reduction, the effective date, identify all parties and the injury, and include medical documentation establishing the basis for the decision.

Employees have 15 days from receipt of notice to request a hearing before the Workers' Compensation Commission; failure to request a hearing results in automatic approval of the discontinuance.

No discontinuance or reduction becomes effective without written approval from an administrative law judge, and hearing requests receive priority over other matters.

Effective October 1, 2022.
