SB 256 - Act Concerning Catalytic Converters

• Motor vehicle recyclers may only receive catalytic converters that are attached to motor vehicles, eliminating the previous requirement to obtain proof of vehicle ownership from sellers.

• Catalytic converters detached by recyclers must have a stock number affixed and be accompanied by a written record containing the recycler's information, vehicle identification number, and stock number when sold or transferred.

• Scrap metal processors, junk dealers, and junk yard operators receiving unattached catalytic converters must record transaction details, seller information, vehicle license plate, and obtain photographs or videos of the seller and converter; alternatively, they may accept converters from licensed recyclers or repair shops with proper documentation.

• Individual sellers may only sell one catalytic converter per day to scrap metal processors, who must pay by check and delay payment to non-business sellers until at least the third business day after purchase.

• Scrap metal processors must submit weekly sworn statements to the Department of Emergency Services and Public Protection detailing all catalytic converter transactions; violations range from class C misdemeanor (first offense) to class A misdemeanor (third or subsequent offense).
