Department of Social Services may assess civil penalties against nursing home facilities that fail to use rate increases designated for employee wage enhancements for that purpose.

Civil penalties shall not exceed 50 percent of the total dollar amount of the rate increase that was not used for wage enhancements.

Department may audit nursing home facilities in accordance with their Medicaid provider enrollment agreements to determine compliance.

Department has sole discretion to enter into recoupment schedules with facilities to avoid negative impact on patient care.

Nursing home facilities may request a rehearing under Connecticut General Statutes section 17b-238, and provisions apply retroactively to all wage enhancement rate increases received under Public Act 21-2 prior to this act's effective date.
