SB 307 - Prosecutorial Accountability Summary

• Establishes an Office of Governmental Accountability to provide administrative support to the Criminal Justice Commission, moving this function from the Division of Criminal Justice (effective October 1, 2022).

• Reduces state's attorney term length from 8 years to 5 years and requires the Criminal Justice Commission to conduct biennial performance evaluations beginning July 1, 2023.

• Requires the Division of Criminal Justice Advisory Board to develop comprehensive prosecutorial policies by November 1, 2023, addressing preliminary case decisions, victim rights, case management, ethics standards, and performance evaluation tools.

• Mandates mandatory training for all prosecutors on racial bias, systemic collateral consequences, conviction alternatives, victim interview techniques, mental illness, and reentry strategies, with at least one day held annually in a state correctional facility (effective July 1, 2023).

• Creates the Office of Governmental Accountability to prepare biennial judicial district performance reports for each state's attorney using case-level data on arrests, charges, dispositions, plea agreements, and demographic information; reports to be made public.
