SB 391 Summary

• Redefines "foreign jurisdiction" to mean any jurisdiction other than a U.S. state, effective July 1, 2022.

• Modifies public-private partnership procurement procedures to require competitive bidding or negotiation and allows prequalification processes for private entities seeking partnerships with the Department of Transportation.

• Requires the Transportation Commissioner to prioritize using department employees for development and inspection services in public-private partnerships, reducing consultant dependency, and allows engineers to be appointed to durational positions without examination if they meet job classification requirements.

• Establishes equipment requirements for frozen dessert trucks including signal lamps, stop signal arms with specific dimensions and markings, convex mirrors, and front crossing arms; first offense for non-compliance is an infraction, subsequent offenses result in fines of $100-$500; effective October 1, 2022.

• Makes minor technical revisions to motor vehicle statutes including clarifications on vulnerable users, school bus equipment standards, snowmobile/all-terrain vehicle penalties, veteran registration plates, and frozen dessert manufacturer licensing requirements.
